Important reforms for applicants of Subclass 309, 820/801, and Subclass 300 visas.

Subclass 309 Visa
  • No Sponsorship Required if relationship ends due to:
    • Death of the sponsor
    • Family violence
    • Having a child from the relationship
  • Location Flexibility: Sponsor-death and child-related provisions apply regardless of applicant's location.
Changes for Subclass 300 (Prospective Marriage) Visa Holders
  • Eligible for Subclass 820/801 even if the relationship ends with a child involved.
  • Onshore Grants: Subclass 300 visas can now be granted while applicants are in Australia (applications still offshore).
  • Family Violence Protections: Extended to Subclass 300 holders, even without marriage.
Additional Key Updates
  • Review rights retained for Subclass 300 refusals (before July 1, 2024).
  • Language updated to “experienced family violence” for greater sensitivity.
  • “Ties to Australia” no longer required for 820/801 if sponsor has passed away.
